Below are details about fiduciary responsibilities and the responsibilities of the broker with regard to each type of listing.


Seller Representation
An exclusive listing is a standard type of listing where the broker exclusively represents the seller and has full fiduciary responsibilities to the seller. The broker and the seller agree to terms and conditions of the sale of the property and the brokerage fees, which are paid to the broker by the seller.

The broker has the following duties: (1) dealing honestly and fairly, (2) loyalty, (3) confidentiality, (4) obedience, (5) full disclosure, (6) accounting for all funds, (7) skill, care and diligence in the transaction, (8) presenting all offers and counter offers in a timely manner, unless a party has previously directed the licensee otherwise in writing, and (9) disclosing all known facts that materially affect the value of real property and are not readily observable.

Osprey Real Estate Services - North Bay, Inc. will make every effort to market the property for sale to all potential buyers, solicit the cooperation of other real estate brokers and enlist their best efforts t secure sale terms which are satisfactory to the seller.


Buyer Representation
Osprey Real Estate Services - North Bay often works in a buyer’s broker capacity searching for properties that meet the investment or purchasing criteria of a potential buyer. Whether the purchase be for a straight investment, a 1031 exchange or for the buyer to occupy the property, Osprey can map out the process of meeting the criteria of the buyer to fine tune the options of what is available that meets the buyers needs. Osprey Real Estate Services - North Bay, Inc. will make every effort to obtain all pertinent information on potential sites and properties which meet the principal’s requirements and to cooperate with other real estate brokers, if necessary, and to enlist their best efforts to secure purchase terms which are satisfactory to the Principal.

Industry standards dictate that the broker be compensated by the seller/owner of the property. However, should any potential property that the principal is considering not include compensation of a commission to Broker by the seller, Broker immediately informs principal of such so that the buyer can make adjustments in any offer price to ensure payment of the appropriate commission to the Broker.

Tenant Representation
Tenants often require the help of a broker to navigate the process of looking for appropriate space for their new or relocating office, industrial or retail space needs. In this instance, Osprey solely represents the tenant with regard to all negotiations.

Osprey Real Estate Services - North Bay, Inc. acquires complete information on all available locations, which meet the preset criteria of the tenant and solicit the cooperation of other real estate brokers and building owners and enlist their best efforts to secure lease terms, which are satisfactory to the Principal. Osprey collects and coordinates the terms and conditions of all proposals for lease but all negotiations are subject to final approval of the tenant and no approval of any document or negotiations shall be assumed until a legal and binding lease agreement has been fully executed. The broker is generally fully compensated for its efforts by the building owner (landlord) upon execution of a mutually acceptable lease.

Landlord Representation

Osprey has represented many office, retail and industrial buildings and has assisted them in leasing up properties. This work encompasses marketing, lease negotiations, advertising, helping to draft proposals, leases for review by legal representation and help with initial space planning. Exclusive representation insures a building landlord that their product is getting out into the community and in front of potential tenants, brokers and that they have current information with regard to lease content, typical lease standard, rent, incentives, etc. This information allows the landlord to be sure that they are obtaining the best credit worthy tenants at the highest and best rental rates in the competitive marketplace.

Osprey Real Estate Services - North Bay, Inc. specializes in commercial real estate lease and sale negotiations. We currently do not handle any property management. Consulting Services
Osprey is often called upon to perform consulting services for an opinion of value, negotiations on existing leases, and other real estate issues. Osprey and none of its employees are lawyers and cannot act or replace the advise of an attorney if necessary or required, but can provide valuable consulting services for an hourly rate depending on the services required.


Disclosure
